1. Acceptance of Terms
By accessing or using the Eximpova platform ("Service"), you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you are acting on behalf of a business, you represent that you have authority to bind that entity.
2. Platform Description
Eximpova is a B2B marketplace connecting Indian manufacturers, artisans, and vendors with domestic and international buyers. We facilitate connections but are not a party to any transaction between buyers and sellers.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. We reserve the right to terminate accounts that violate these Terms.
4. Vendor Obligations
Vendors must: (a) provide accurate product information and pricing; (b) fulfil orders as described; (c) maintain appropriate export/import licences; (d) comply with all applicable laws including GST regulations; (e) not list prohibited or counterfeit goods.
5. Buyer Obligations
Buyers must: (a) provide accurate shipping and billing details; (b) make payment as agreed; (c) comply with import regulations of their country; (d) not misrepresent the intended use of purchased goods.
6. Payments and Fees
All transactions are between buyers and sellers. Eximpova may charge platform fees as disclosed at the time of transaction. Prices are displayed in the currency shown and are subject to applicable taxes.
7. Intellectual Property
All content on the platform — including logos, text, images, and software — is owned by or licensed to Eximpova. You may not reproduce, distribute, or create derivative works without our prior written consent.
8. Limitation of Liability
Eximpova is not liable for: (a) quality or fitness of products; (b) delays or non-delivery by vendors; (c) customs clearance or import duties; (d) any indirect, incidental, or consequential damages arising from use of the platform.
9. Dispute Resolution
Disputes between buyers and vendors should first be resolved through our in-platform resolution centre. Unresolved disputes shall be subject to arbitration in accordance with Indian Arbitration and Conciliation Act, 1996. Jurisdiction: Noida, India.
10. Governing Law
These Terms are governed by the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of courts in Noida.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of the revised Terms. Material changes will be notified via email.
